FACILITY HIRE AGREEMENT

Terms and Conditions of Hire:


1. Usage of Warrandyte Community Church - By hiring the facility, Warrandyte Community Church in no way relinquishes its right to control the management of the Facility and to enforce all necessary rules and regulations as may be required. Warrandyte Community Church may use other components of the facility during the event that do not materially interfere with the usage by the applicant.


2. Timing of Payment - Payment is to be received by Warrandyte Community Church prior to the event. Quoted prices do not include GST, GST is an additional cost and will be added to the invoice. 


3. Cancellation - Warrandyte Community Church will refund in full for any event which is cancelled, provided that at least 48 hours advanced notice is given of the cancellation. If in the event that 48 hours advanced notice is not given, then Warrandyte Community Church may charge a fee of up to 1/3 of the total event fee as liquidated costs for the cancellation.

4. Cleaning - I undertake to leave the rooms hired in a clean and tidy state. I understand if that if the room is not left tidy I may incur a cleaning fee of $100. 

5. Damages - The Applicant is responsible for any damage that occurs to the Facility and/or equipment because of the Applicants use (reasonable use excepted). An inspection will be done by Warrandyte Community Church after the event. If damage occurs, an estimate of costs for the repair will be determined by Warrandyte Community Church acting reasonably, the Applicant will be contacted, and invoiced for the required repairs.


6. Event Preparation -  All furniture and equipment, if moved in preparation for the event, is to be the sole responsibility of the Applicant and shall be restored to its original position at the end of the event. All decorating for the event shall be done safely and in accordance with the proposed activities and be the sole responsibility of the Applicant unless otherwise arranged. No decoration shall be fastened to the wall of the facility or otherwise affixed in such a manner that will damage the facility. Take down and cleanup of the Facility is also the sole responsibility of the Applicant unless otherwise arranged. In 'Event Publicity' the hirer agrees to make clear that the views expressed by the event, speaker or staff do not necessarily express the views held by the Warrandyte Community Church. 


7. Prohibited Activities - Warrandyte Community Church is part of the Christian Community Church National network and will not hire the facility to any group whose constitution or intended usage of the facility contravenes the Articles of Faith of Warrandyte Community Church. Warrandyte Community Church reserves the right to terminate the event booking if there is a discrepancy between the actual event and the description of the event produced by the Applicant in this document, such that the actual event materially contravenes those Articles of Faith, in which Warrandyte Community Church shall repay in full any deposit paid by the Applicant without further liability of either party.
Smoking and drinking alcohol are prohibited activities on Warrandyte Community Churches premises.


8. Insurance - Warrandyte Community Church will maintain all risk insurance with respect to its property and equipment as well as comprehensive general liability insurance for injury and property damage arising from Warrandyte Community Churches use, occupation or operation of the premises. It is recommended that all hirers hold their own public liability policy for the event. [These may be available through a home insurance policy for small events.]


9. Indemnity - The applicant agrees to indemnify and hold blameless Warrandyte Community Church, its officers, agents and employees of and from all demands, claims, suits, actions or liabilities resulting from injuries, death to any person or from any property damage occurring during the rental term arising by reason of any breach, violation or non-performance under this agreement by the Applicant, its directors, agents, or employees.
Warrandyte Community Church agrees to indemnify and hold harmless the Applicant, its officers, agents and employees of and from all demands, claims, suits, actions or liabilities resulting from injuries, death to any person or from any property damage occurring during the rental term arising by reason of any breach, violation or non-performance under this agreement by Warrandyte Community Church, its officers, agents, or employees.


10. Church Closure / Emergency - Warrandyte Community Churches Bushfire Policy states that all its Facility will shut down on days where the Fire Danger Rating is EXTREME or CODE RED. To access information about Fire Danger Rating for each day visit http://www.emergency.vic.gov.au. In the event an activity is booked on a EXTREME or CATASTROPHIC day the activity will be required to be cancelled and hire fees will be refunded in full. It is essential you familiarise yourself with and take responsibility to be aware of the evacuation diagram identifying your closest exit and the emergency evacuation point. This infomation is located beside all the main entrance/exit external doors on each level of the bulding. In all Watch and Act situations adhere to the advice given by the relevant authorities and evacuate where safe to do so. 


11. Binding Effect - This document shall constitute the sole and entire agreement between parties and intended to create legal obligations. The undersigned hereby warrants that it has the authority to bind the applicant as per Terms and Conditions. This document shall not be of any effect unless executed by both parties.

12.
